How to Spot Medical Malpractice: Warning Signs

Back to All stories

Medical professionals do not have the ability to save everyone from harm. However, they are expected to provide a reasonable standard of care. If you are unsure whether or not your doctor committed medical malpractice or negligence, check out our list of warning signs.

People get hurt and fall ill every day and despite the best of intentions, sometimes medical treatments and surgeries do not work. However, this does not exclude the possibility of avoidable medical errors and mistakes happening.

If you suspect that your doctor or another medical professional acted carelessly prior to you being injured, there is a chance you might be right. Below, we have compiled some common red flags that sometimes indicate medical negligence or malpractice.

1. Other doctors disagree with your doctor’s treatment

If you think that you might not be receiving the best level of care and/or you suspect that your doctor’s recommendations are not what is best for you, you should seek a second or even third opinion. If other doctors disagree with how your doctor has been treating you, it may be a red flag that your physician is not acting as a reasonable doctor in the same situation would.

2. Your symptoms aren’t being taken seriously

If your pain and symptoms are being repeatedly brushed off by your physician, it might be a red flag that something is wrong. For many health conditions, the time of diagnosis plays a significant role in the likelihood that treatment will be successful. If your physician is not recommending that tests or similar measures be taken to help understand why you may be experiencing the symptoms that you face, you should seek another opinion to make sure that a serious health condition is not to blame.

3. Medical staff seem rushed and understaffed

Oftentimes medical negligence is simply the result of insufficient staff. If nurses and doctors have too many patients to see, they are likely not giving each patient the amount of time and care that they need. Procedures may be rushed, causing mistakes to be more likely to happen. Infections may also be more likely if patients are not properly looked after.

4. Your treatment seems unnecessary

Sometimes doctors are financially incentivized to prescribe certain procedures, medical devices, or medications. If you have concerns about whether or not the risks and costs of treatment outweigh the benefits, you should seek a second opinion to make sure that the particular procedure is medically necessary.

What to Do If You Think Your Injury Was Caused By Medical Malpractice

If you believe that you were injured as a result of a medical professional’s mistake or lack of care, you may be eligible to file a medical malpractice lawsuit. A lawsuit can help recover compensation for any medical expenses and loss of earnings you experienced as a result of your injury. It can also compensate you for the unnecessary pain and suffering you face due to the medical provider’s negligence.

The medical malpractice experts at MedFault can review the circumstances leading up to your injury to help assess whether or not you might be eligible to file a lawsuit.
